TERMS OF SERVICE

TIMELINE

  • The process I will be following will be a queue list. This means It will be in the order of clients that have reached out and made a payment first, ending with the most recent client’s commission received. No payment = no spot.

  • My usual workflow: sketch > flats > painting(shadow and light) > merge & rendering > blendmode/filters & final touches > finished artwork!

  • *workflow may change depending on the art style preferred.

  • Time of art commission completion will be between 1 week – 3 weeks, which highly depends on the art style chosen and the complexity of the piece. However, please remember that your queue turn isn’t a factor in this.

  • Please do not rush me if my estimated time is not nearing its end yet, and kindly do not expect me to finish the day after you have ordered a commission.

  • Short deadlines will have to be negotiated prior to anything. A fee may be included depending on the date and how long the art style chosen often takes.

  • If an unforeseen event occurs that could delay or prevent the completion of your art piece, you’ll be contacted and informed about it as soon as I find the ability to do so.

  • The finished artwork will be sent via email.

COMMISSION REQUEST

  • Please provide visual references of any original characters, environments, or backgrounds. I will not work off text-heavy descriptions alone unless you are paying specifically for design work, which I also offer.

  • Please describe how you want your artwork to be. The posing, expressions, outfit, lighting, down to small details (mole, scar, etc.). Sending visual references will help me understand what you want more clearly, which will be alongside text descriptions and directions.

  • If you’re unable to find a reference photo, do not be shy to also send your own sketches or a simple doodle to help us work towards your intended goal.

  • *Note that the artist retains the right to refuse a commission request.

PAYMENT

  • Payment will be through PayPal invoices ONLY. If you have any difficulties with paying for your commission please talk to me directly and I'll try my best to work through it with you.

  • The client is free to pick between two payment options:

A) 100% of Payment is upfront. This is a preferred option to avoid the loss of an unnecessary amount in taxes.
B) 50% of Payment upfront & %50 of payment after I have received your approval for the final sketch phase

  • No commission will be started until they are paid for

  • Base prices are subject to change based on the complexity of the request, this will be negotiated with the client

  • I DO NOT accept refunds or cancellations, once the commission has gone past the sketching/revision phase you have agreed that you are happy with it and the work is to be finished

REVISIONS

  • Revisions during the sketch phase are free of cost, regardless of how small or big. This stage is crucial to reaching your satisfactory goal

  • Honesty is very important during revisions, if you are unhappy with anything, let me know so I’m able to correct it as fast as possible

  • After the final sketch phase approval, revisions get harder but are still possible.

  • Communication is the key to hopefully making both parties satisfied:

A) Small revisions are free of cost, such as color corrections, changing an expression, or other similar simple tasks. However, please note that frequent revision requests will be charged, so please be mindful and honest as soon as possible, while mentioning everything you deem in need of change.
B) Major revisions such as pose changing, a different composition or character/ outfit design etc.. past the stage of the final sketch phase will incur additional charges to the original commission price.

  • As requested previously in the contract, if you have a very clear image of what you are going for I will need you to clarify and give as much detail as early in the process as you can.

  • Please note that revisions exclude requests to change the artist’s art style. You are fully responsible for picking this artist and the style of their work.

COPYRIGHT POLICY

  • All artwork is for personal use only unless agreed otherwise. This means clients can claim the rights of their own character (s) and have the ability to share the work on social media/use it as a wallpaper/icon or on Toyhouse. Clients also have the right to print and hang it on their wall or gift it to a friend, however, you do not own the rights to the drawing itself.

  • Please do not reproduce the artwork for mass consumption/ promotional work/ marketing for a product or company/ selling as prints, stickers, or any sort of product and any similar commercial use without the proper commercial license.

  • Clients may not take credit for the artwork, trace or alter the work in any way or form, nor can clients request another person to do so.

  • Training and processing the artwork through any AI training and generative site/device is strictly prohibited.

  • Reproducing a commission for any blockchain-related reasons, including NFTs, is also prohibited.

  • The artist retains the right to post the commissioned artwork’s final product and/or the artwork while still being in progress on their website or social media, which is considered a means of marketing for the artist.

  • A request to keep the commissioned artwork private and/or remain unposted by the artist will include a fee.

COMMERCIAL LICENSE

  • Non-exclusive license starts at +100%. This means the client has the rights to reproduce and use the artwork for commercial use, but also, it grants the artist to reproduce and use the artwork for commercial use as well as selling and licensing the artwork as they wish.

  • Exclusive license starts at +150%. This means the client has the rights to reproduce and use the artwork for commercial use as the client wishes, and it does not grant the artist any rights to sell and license the artwork. However, the owner may not own the copyright to the artwork & can only use it as explicitly stated in the contract.

By commissioning this artist you understand and agree to the terms and conditions. Any breach will result in immediate termination of your request, no refund will be allowed and legal action will be taken.
